Public offer
Agreement for the distance retail sale of goods (pre-order). Astana, Republic of Kazakhstan.
This document is a public offer by the seller identified in section 19 “Seller Details” (the “Seller”, “TimSeven”), under Article 395 of the Civil Code of the Republic of Kazakhstan. The Seller offers any legally capable individual to enter into a sale agreement for TimSeven goods on the terms below. By placing and paying for an order on the Website, the Buyer fully and unconditionally accepts these terms.
1. Definitions
1.1. Website — the Seller’s website timseven.store (and timseven-store.vercel.app), including all pages and language versions.
1.2. Buyer — an individual aged 18 or over who places an Order for personal, family or other needs not related to business activity.
1.3. Collection — a limited numbered edition of Goods released once (e.g. Collection 01 · Muslim Pack, 1,448 sets).
1.4. Set (Goods) — a set of Collection items sold only as a whole. The contents are stated on the Collection page. For Muslim Pack: seven T-shirts in one size, a box, a prayer mat in its case and a fragrance.
1.5. Pre-order — an Order for a Set that is produced after payment, within the time frame stated on the Collection page.
1.6. Number — the serial number of a Set within the Collection edition (“X of N”).
1.7. Order — the Buyer’s request placed on the Website to buy a Set, with the chosen size, country and delivery address.
1.8. Early Access — the sales period before open sales, available via a personal link.
1.9. Recipient — the person to whom the Set is delivered if the Order is placed “As a gift”.
2. Subject of the Agreement
2.1. The Seller undertakes to produce a Set and transfer it into the Buyer’s ownership, and the Buyer undertakes to pay for and accept it under this Offer.
2.2. The description, contents, colours, materials (for Muslim Pack: long-staple cotton, 195–200 g/m²), price, edition size and timelines are stated on the Collection page and at checkout. This information forms an integral part of the Offer.
2.3. Images on the Website, including references and the lookbook, are illustrative. On-screen colours may differ from actual colours due to device settings. Such differences are not a defect.
2.4. Sets are intended for personal use. The Seller may refuse or cancel an Order with a full refund if there are grounds to believe Sets are bought for resale, in quantities beyond reasonable personal need, or by automated means.
3. Placing an Order and Conclusion of the Agreement
3.1. The Buyer places an Order on the Website: chooses a size (one for the whole Set), country, address and delivery method, and provides a name, phone number and email.
3.2. The Buyer is responsible for the accuracy of the data provided. The Seller is not liable for delays or non-delivery caused by an incorrect address or contact details.
3.3. The agreement is concluded when payment is confirmed. The confirmation, the Number and a link to the order page are sent to the Buyer’s email.
3.4. For an Order “As a gift”, the Set is delivered to the Recipient at the Recipient’s address. All notifications and rights under the agreement remain with the Buyer.
3.5. The number of Sets in a Collection is limited. If the edition sells out before payment is confirmed, the Seller cancels the Order and refunds the full amount.
4. Price
4.1. The price of a Set is stated on the Collection page in US dollars (for Muslim Pack — USD 350 for a set of seven T-shirts). The price is the same for all Buyers.
4.2. For delivery to the Republic of Kazakhstan, card payments are made in tenge. The amount is calculated at the official exchange rate of the National Bank of the Republic of Kazakhstan on the date of the Order, rounded up to the nearest 100 tenge, and shown at checkout before payment. In all other cases (other delivery countries, payment via PayPal or in USDT), settlement is in US dollars.
4.3. The delivery cost depends on the country and is shown before payment.
4.4. Customs duties, taxes and fees of the destination country are not included in the price or delivery cost and are paid by the Buyer (Recipient) on receipt.
4.5. The price of a paid Order does not change. The Seller may change prices for new Orders.
4.6. An obvious technical error in the price does not oblige the Seller to sell at that price. In that case the Seller offers to confirm the Order at the correct price or cancels it with a full refund.
5. Payment
5.1. Payment is made in full (100% prepayment) at checkout: by Visa or Mastercard, via PayPal, or by USDT (TRC-20) transfer, where the method is available for the Buyer’s country.
5.2. Card payments are processed by payment providers. Card details are not passed to or stored by the Seller.
5.3. When paying in USDT, the Buyer transfers the exact amount to the address shown at checkout on the TRC-20 network. Network fees are paid by the Buyer. Transfers on another network or to another address may be lost; the Seller is not liable for this.
5.4. Fees of the Buyer’s bank or payment system, including currency conversion fees, are paid by the Buyer.
5.5. An electronic receipt or payment confirmation is sent to the Buyer’s email.
6. Pre-order and Production
6.1. Sets are produced in batches after Orders are paid. The Buyer understands that the Set has not yet been produced at the time of payment.
6.2. Estimated dispatch dates are stated on the Collection page. The Seller notifies the Buyer by email of the start of production, dispatch and other stages.
6.3. If dispatch is delayed by more than 30 calendar days, the Seller informs the Buyer of the new date. Within 14 days of that notice, the Buyer may cancel the Order and receive a 100% refund, even if production has started.
6.4. The Seller may make minor changes to the items (shade, trims, packaging materials) that do not reduce quality or functional properties.
6.5. The size chart is published next to the size selector. Item measurements may deviate by up to ±2 cm from the chart.
7. Set Number
7.1. The Number is assigned automatically in the order of confirmed payments and cannot be chosen.
7.2. The Number is shown on the order page and in the email.
7.3. If an Order is cancelled or returned, the right to the Number is lost and the Number may be assigned to another Buyer.
8. Delivery
8.1. Delivery is made to the countries available at checkout by courier and postal services chosen by the Seller.
8.2. Estimated timelines: Kazakhstan — by mid-January 2027; UAE, USA and other countries — 14–21 days after dispatch. Carrier and customs timelines are estimates.
8.3. After dispatch the Buyer receives a tracking number. Delivery status is determined by the carrier’s data.
8.4. The Buyer (Recipient) must accept the Set and check the packaging on delivery. Any damage must be reported to the courier and to the Seller with photos within 48 hours.
8.5. If the Set is not received through the Buyer’s fault (wrong address, refusal, unpaid duties, storage period expired) and is returned to the Seller, re-delivery is paid by the Buyer. If the Buyer declines re-delivery, the Seller refunds the price of the Set minus delivery costs both ways.
8.6. Ownership and the risk of accidental loss of the Set pass to the Buyer upon delivery to the Buyer or the Recipient.
9. Order Cancellation
9.1. The Buyer may cancel the Order and receive a 100% refund until the Seller notifies them that production of the batch has started.
9.2. After production starts, cancellation is not possible, except in the cases of clause 6.3 and section 11.
9.3. The Seller may cancel an Order with a full refund if performance is impossible (edition sold out, delivery to the country becomes impossible, sanctions or regulatory restrictions, breach of clause 2.4).
10. Return of a Set of Proper Quality
10.1. A Set of proper quality may be returned within 14 calendar days of delivery.
10.2. Only the complete Set may be returned: seven T-shirts with no signs of wear, washing or odours, with tags; the box; the mat in its case; the fragrance in its original unopened packaging.
10.3. To arrange a return, the Buyer emails support with the Order number and the reason. The Seller provides the return address and procedure. Returns sent without agreement are not accepted.
10.4. Return shipping is paid by the Buyer. The original delivery cost and the duties and taxes of the Buyer’s country are not refunded.
10.5. If the law of the consumer Buyer’s country of residence grants broader return rights, those rights apply.
11. Defective Goods
11.1. The Buyer reports a defect (manufacturing defect, mismatch with the Order contents or size) within 30 calendar days of delivery, with photos or video.
11.2. At the Buyer’s choice, the Seller replaces the item (Set) or refunds the full price of the Set and delivery. All shipping costs are borne by the Seller.
11.3. The following are not defects: natural wear, damage from improper care (contrary to the care label), mechanical damage after delivery, colour differences within clause 2.3.
11.4. The Seller may carry out a quality inspection. If the defect arose through the Buyer’s fault, the Buyer reimburses the inspection and shipping costs.
12. Refunds
12.1. Refunds are made by the same method used for payment (card, PayPal, USDT to the source wallet on TRC-20) within 10 business days after the Order is cancelled or after the returned Set is received and inspected.
12.2. The time for funds to reach the card depends on the issuing bank and may take up to 30 days.
12.3. Refunds are made in the same currency and amount as the payment. Exchange rate differences and the Buyer’s bank fees are not compensated.
13. Liability
13.1. The parties are liable for non-performance under the laws of the Republic of Kazakhstan.
13.2. The Seller’s total liability for an Order is limited to the amount paid by the Buyer for that Order, except where such limitation is prohibited by law.
13.3. The Seller is not liable for the actions of carriers, customs authorities and payment systems, or for delays they cause, but will assist the Buyer in resolving the matter.
14. Force Majeure
14.1. The parties are released from liability if non-performance is caused by force majeure: natural disasters, epidemics, military action, acts of public authorities, sanctions, transport restrictions, third-party production failures resulting from such events.
14.2. Performance deadlines are extended for the duration of such events. If they last more than 60 days, either party may terminate the agreement; the Seller refunds the Buyer 100% of the payment.
15. Intellectual Property
15.1. The TimSeven trademark and name, the design of the items and packaging, texts, photographs and other Website materials belong to the Seller or are used lawfully.
15.2. Any use of these materials without the Seller’s written consent, including making and selling copies of the items and packaging, is prohibited.
16. Personal Data and Notices
16.1. By accepting the Offer, the Buyer consents to the collection and processing of their personal data (and of the Recipient’s data, which the Buyer is entitled to provide) to fulfil the Order, in accordance with the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” and the Privacy Policy (timseven.store/en/legal/privacy).
16.2. Data is shared with carriers and payment providers only to the extent needed to fulfil the Order, including outside the Republic of Kazakhstan.
16.3. Service emails about the Order (confirmation, Number, status updates, tracking number) are sent to the Buyer’s email. Marketing emails are sent only with separate consent; the Buyer may unsubscribe at any time.
16.4. Legally significant notices are sent by email: to the Buyer at the Order email, to the Seller at the support email.
17. Governing Law and Disputes
17.1. The agreement is governed by the laws of the Republic of Kazakhstan, including the Civil Code, the Law “On Consumer Rights Protection”, the Law “On Regulation of Trade Activities” and the Digital Code of the Republic of Kazakhstan.
17.2. This choice of law does not deprive a consumer Buyer of the protection afforded by the mandatory rules of their country of residence.
17.3. The parties resolve disputes through negotiation. A claim is sent to the support email; the response time is 10 calendar days.
17.4. If a dispute is not settled, it is heard by the court at the Seller’s location, unless consumer protection law provides otherwise.
18. Term and Amendment of the Offer
18.1. The Offer is effective from its publication on the Website until withdrawn.
18.2. The Seller may amend the Offer by publishing a new version on the Website. Paid Orders are governed by the version in force at the time of payment.
18.3. If any provision is held invalid, the remaining provisions remain in force.
18.4. The Offer is published in Russian, Kazakh and English. In case of discrepancy, the Russian text prevails. Translations of the Offer into other languages, including Arabic, are for information only.
